tjbailey Internet Services Website Development & Hosting Policy
We reserve the right to suspend or cancel a customer's account at any time if we feel that the client has violated our policy, or if we decide that the account has been inappropriately used.
tjbailey Internet Services is not responsible for the content of any of its customer's sites. It is our policy not to allow adult, hate, obscene, warez, or any other objectionable or illegal material as determined solely by us. Any customers violating these terms will be subject to immediate deactivation without notice.
If a client prefers to use alternate hosting services, they will be responsible for those account renewals and costs.
Each account comes with its own cgi-bin. You are free to install and use any CGI scripts you wish, however, we reserve the right to disable any CGI script that adversely affects normal server operation without prior warning. Scripts may be banned from use at the sole discretion of tjbailey Internet Services.
Forums / Blogs
We do not allow clients to install their own chat rooms, forums or blogs without approval. Most chat rooms tend to be large system hogs and therefore we cannot allow them as an account option. However, we are more than happy to set up a Forum Program or Blog that will more than meet your needs and run without hindering the performance of the machine for others. Our Blogs and Forums are hosted on 3rd party servers.
In accordance with our policy, web development and hosting must be paid in full, in advance. All new accounts are set up on a pre-pay basis. All pricing is guaranteed for the term of pre-payment. Any account that is overdue is subject to suspension and may be terminated at any time. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies us for a request for termination of services. All payments will be made in U.S. currency.
Annual web hosting and/or site maintenance invoices are emailed out approximately 15 - 20 days in advance of the expiration date and one follow up reminder email will be sent out a few days prior to expiration. If payment has not been received by the annual hosting renewal date, the site will be taken offline. If a site is taken offline due to lack of payment, a reactivation charge of $25.00 will apply and be added to the amount owed for the pending renewal period.
Web Hosting & Maintenance
tjbailey Internet Services bills annually and in advance for web hosting & maintenance services. The fee depends on how much editing / updating we do over the course of a year as well as the amount of system resources that are being used which include the number of email accounts connected with the website and/or whether a shopping cart / webstore has been set up. Two hours of site updating is included with your standard web hosting & maintenance fee. Additional hours of site updating will be billed at the rate of $25.00 per hour. Any unused site updating cost does not roll over. In the event a client cancels service, any unused hosting and maintenance cost for the current billing period is forfeited.
Quotes & Proposals
We do our best to calculate the hours needed to perform the work planned based on the correspondence with a prospective client either though emails or phone conversations. Quotes for new website builds and ongoing site updating are estimates only and may be subject to revision based on the scope of the work involved, additional options and features that may be added to the site and frequency of the updates. In most cases, 1 year of website hosting will be included in the original web development quote.
tjbailey Internet Services reserves the right to refuse service to anyone. Customers may only use our servers for lawful purposes. Transmission of any material that is in violation of any Federal, State, or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to to be threatening or obscene, and material protected by trade secrets. tjbailey Internet Services does not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin, disability, marital status, sexual orientation, or military status.
We do our best to ensure no images, videos, or paragraphs of text are in violation of any copyright laws. If we are notified of a copyright violation, we will immediately remove the item(s). tjbailey Internet Services will not be held responsible for any copyrighted materials that were provided to us by our clients.
All images including artwork, photos, videos, logos and any other form of graphic materials will be provided to us for inclusion on our client's websites. Clients will be responsible to ensure these materials are not copyrighted and will be held accountable should any copyright infringements occur.
tjbailey Internet Services including its employees will not be held accountable or liable for any legal issues arising out of any use of copyrighted material.
Your hosting account includes domain specific email accounts, ie: email@example.com. These free email accounts are provided through CPanel. CPanel email accounts are not 100% reliable. Due to the vast amount of spam emails circulating around the Internet, many large email services such as Gmail (Google), Yahoo email, Outlook email AOL email and others often block incoming emails originating from Cpanel email services. The best and most reliable solution for handling emails is with Office 365. This is a paid subscription payable to godaddy directly - not to tjbailey Internet Services and is supported by godaddy who provides this software. tjbailey Internet services does not support CPanel email.
tjbailey Internet Services will not be held responsible for any loss due to issues with your CPanel email services.
Customer agrees that it shall defend, indemnify, save, and hold tjbailey Internet Services harmless for any and all demands, liabilities, losses, costs and claims, including attorney's fees asserted against tjbailey Internet Services, its agents, officers, and employees that may arise or result from any service provided, or performed, or agreed to be performed, or any product sold by a customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless tjbailey Internet Services against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with our servers; (2) any material infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to a customer from our servers.
tjbailey Internet Services will not be responsible for any damages your business may suffer. tjbailey Internet Services makes no warranties of any kind, expressed or implied for the services we provide. tjbailey Internet Services disclaims any warranty or merchantability or fitness for any particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, unauthorized access and any, and all service interruptions caused by tjbailey Internet Services and its employees.
We are happy to update or rebuild your existing site and provide hosting, if desired. In cases where we provide hosting, we will contact you either via phone call or email to inform you that you no longer need hosting services provided by your old hosting provider. It is your responsibility to cancel these services.
We encourage you to register your own domain name. We can provide that service for you, however domain name registrations or renewals are not included in website hosting. Your domain name has to be renewed at least annually. We renew domain names for 5 years at a time to save a little money. You will be notified a few weeks in advance with an email sent to the email address we have on file for you. It is your responsibility to notify us if your email address has changed. If your domain name expires, your site is automatically removed - this is out of our control. Your domain name points to the web server where your site resides. If the domain name expires, it cannot point to a server.
Use of Templates
Many websites are built using Wordpress themes, however, we do not use Wordpress due to that platform's inherent security issues. This also applies to using Magento, Mambo, Joomla and others. These are 'open source' projects with many back doors and complicated code. These interfaces are difficult to manage, edit and keep updated with numerous security patches that are constantly being issued. These platforms are system resource hogs and time consuming to maintain. Google 'wordpress hacked' and review some of the horror stories.
Using a template, especially one that is designed to be mobile device friendly, will save you money. Modern responsive templates are designed to display properly (and look the same) on all devices including desktops, laptops, notebooks, ipads and smart phones and display the same on all browsers including Google Chrome, MSIE, Firefox, Opera and Safari. These templates must be purchased in order to comply with copyright terms and permission to remove the backlink to the designer's website. This is a relatively lost cost compared to the billable hours it would take to custom build a website from the ground up.
Templates are designed to use 'out of the box' as is, changing only the images, including banners, page titles and text content in order to suit your business name, brand, contact info, and other editable content - and not tamper with the layout design. In other words, moving an element such as a navigation menu link stack, feature presentation, or other design element 'from here to there' will break the code causing all kinds of problems including follow up editing involving countless hours patching supporting files. Not to mention after such radical editing, the site most likely not display the same or correctly on all browsers, ipads and smart phones.
Customizing a template is not an issue if we follow the above guidelines. Pages can be added, some design changes can be made without any problems and we are happy to work with you to accommodate any such requests. However, after attempting to alter the design, we find that those alterations cause significant issues, we will notify you to discuss options and work-arounds.
Pointing to another webite saying "they did it" - resolves nothing - "their site" may be managed by an in-house team of full time web development employees whose only job is to manage that company's website week in and week out, or another developer using a completely different template or custom code matrix. Mixing and matching does not work.

We incorporate state of the art security measures and monitor our network around the clock. However, we cannot be responsible for, or liable for any lost data or compromised files as a result of unauthorized access.
